You are most correct. In the situation where the "vendor" has
operational control (ie hires pilots,mainteance etc) and provides these
things then You the program are the customer who is being transported
for "compensation or hire" and being billed by the vendor.

which brings up another interesting legal point. In this case who is
billing the "patient"? The vendor cannot bill under another name but his
own unless he has a register DBA.The program or the hospital cannot bill
unless they are the 135 certificate holder? Or pehaps they are a
licensed charter "broker"?

Need a little more information on this. This may not be possible.
Correct me 
if I'm wrong ( and I'm sure someone will :-) ) but if you use a vendor,
Your 
company is the customer and that would put ya'll under part 135 at all
times. 
We tried to do this with a former vendor as the pilots kept running out
of 
duty time and we would get stuck somewhere on long distance transfers.
As we 
were the one's paying the vendor, we were the customer and as long as we
were 
aboard---Part 135.
