Re: Patient Scenarios (correction/clarification)
One of my eagle-eyed colleagues pointed out an inconsistency between my last
two posts. In the first I made a statement "(thankfully, always as a
witness, never as a defendant)" referring to depositions and trials in which
I have participated. This seems at odds with my second post wherein I
reported an experience in which I was clearly a defendant prior to and
during the deposition. A correct statement would have been that I have
thankfully never had to go to trial as a defendant but only as a subject
matter or expert witness.
I apologize for the mis-statement in the first post. In a legal proceeding,
that is exactly the sort of inconsistency that an opposing attorney could
use to undermine the credibility of a witness. In spite of my best efforts
to choose my words carefully, I occasionally fall prey to sloppy editing and
this was one of those times.
